Hard To Find Whisky Trade operates under Hard To Find Distribution Ltd.
In these Terms and Conditions, “the Company” refers to Hard To Find Whisky Limited and “the Customer” refers to the applicant requesting a trade account.
2.1 All trade account applications are subject to approval at the Company’s discretion.
2.2 The Customer must be a registered business and may be required to provide company registration and VAT details.
2.3 The Customer must hold a valid alcohol licence where required under the Licensing Act 2003 and provide evidence upon request.
2.4 The Company reserves the right to carry out credit and compliance checks before approving an account.
3.1 The Customer agrees to comply with all applicable laws and regulations relating to the sale and distribution of alcohol.
3.2 The Customer must not sell alcohol to individuals under the legal drinking age (18 in the UK).
3.3 The Company reserves the right to suspend or terminate accounts if it reasonably believes the Customer is in breach of licensing laws or responsible retailing practices.
4.1 Trade pricing is confidential and available only to approved account holders.
4.2 The Company reserves the right to amend prices, discounts, or product availability at any time.
4.3 All prices are subject to VAT and applicable alcohol duties unless otherwise stated.
5.1 Standard payment terms are invoice per order, unless otherwise agreed and approved otherwise by the Company.
5.2 Credit limits may be applied and reviewed at the Company’s discretion.
5.3 The Company reserves the right to suspend or withdraw credit facilities if payment terms are not adhered to.
5.4 Late payments may incur interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
5.5 All outstanding balances become immediately payable if the account is suspended or terminated.
6.1 All orders are subject to availability and acceptance by the Company.
6.2 Delivery dates are estimates only and not guaranteed.
6.3 Deliveries of alcohol must be accepted by a person aged 18 or over.
6.4 The Company reserves the right to refuse delivery if age verification or licensing concerns arise.
6.5 Risk in the goods passes to the Customer upon delivery or collection.
7.1 The Customer must inspect goods upon receipt and report any shortages, damages, or breakages within 24 hours of receipt.
7.2 Returns are subject to prior agreement and may incur a restocking fee.
7.3 Due to the nature of alcohol products, returns of non-faulty goods may be restricted.
7.4 Faulty or defective goods will be replaced or credited at the Company’s discretion.
8.1 Ownership of goods shall remain with the Company until full payment has been received.
8.2 The Company reserves the right to recover goods where payment has not been made in accordance with agreed terms.
9.1 The Customer is responsible for all purchases made under their account.
9.2 Account details must not be shared without prior written consent from the Company.
10.1 The Company reserves the right to suspend or terminate any trade account at its discretion.
10.2 Grounds for termination include, but are not limited to:
11.1 The Company shall not be liable for any indirect or consequential loss, including loss of profits or business interruption.
11.2 The Company’s total liability shall not exceed the value of the goods supplied.
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
By applying for and using a trade account, the Customer agrees to be bound by these Terms and Conditions.
